For Inpro Analytics OG (“we” or “us”), as the controller responsible for processing personal data within the meaning of the EU General Data Protection Regulation (GDPR), the protection of your personal data is of utmost importance. When processing personal data, we therefore comply with all requirements of the EU General Data Protection Regulation (GDPR), the Data Protection Act (DSG), and other national and European legal regulations, and strive for the greatest possible transparency. With regard to data security, we take appropriate technical and organizational measures to ensure that your personal data is secure with us.


We process personal data in accordance with the principles of lawfulness, fairness, transparency, accuracy, purpose limitation, data minimization, storage limitation and integrity as well as confidentiality.

We would also like to point out that various data transmission methods, such as sending unencrypted emails, do not offer comprehensive protection against access by third parties.

3. RECEIVER

Depending on the specific processing activity, it may be necessary to forward your personal data to standard industry service providers such as postal service providers, lawyers, tax advisors, auditors, payment service providers, or other third parties. Given that some of these service providers are engaged on a project-specific basis, it is not currently possible to provide a precise list of these providers.


Depending on the purpose of the processing, we may transfer your personal data to processors commissioned by us, provided this is necessary to fulfill the respective task. We ensure that our processors comply with data protection regulations. Furthermore, agreements have been concluded with these processors to guarantee that personal data is processed confidentially and carefully.

4. PROCESSING OF YOUR PERSONAL DATA

Below we describe how we process your personal data.


4.1. Categories of personal data

​Depending on the contract or purpose, the following categories of personal data may be processed:


a) Personal details: Name/company/other business name, address, telephone number, email address, date of birth, etc.

b) Log files: IP address, operating system, referrer URL, entry and exit page, browser type, browser version, country, date and time of server request, mail data (sender/recipient IP address, date and time of mail, mail server, etc.), etc.

c) Payment details: Bank and credit card details, transfer information, etc.

d) Appointment details: Date and time of the (desired) appointment, location, title of the appointment, etc.

We process your personal data to ensure stable website operation, to identify, analyze, and resolve problems, and to prevent attacks on our website. This allows us to operate our website properly, stably, and securely, and to improve and further develop our online presence.

Data processing is based on our legitimate interest. We have a legitimate interest in ensuring that our website can be operated properly and securely. On the one hand, we want to protect our website visitors, and on the other hand, we want to deliver our website content appropriately to our website visitors. This data will not be combined with other data sources. To achieve these goals, we use external service providers.

When you contact or communicate with us via email, contact form, messenger or in any other way, we process your personal data as follows:

In other cases, we process your personal data in accordance with Article 6(1)(f) GDPR; this means that the processing of personal data is based on our legitimate interest in processing your inquiry. It is important to us to process the requests submitted to us and to ensure fast and secure communication.


d) Recipient

Your data will be transmitted to recipient LfdNr 1.

If you do not want us to process your personal data, we cannot process your request.


4.4. Business partners and customers

We process your personal data, if you are our (future) business partner or customer, as follows:


a) Processing of personal data

Personal details, log files, payment data or data relating to (i) the delivery of goods, (ii) the provision of services and/or (iii) other contracts.


b) Purpose of data processing

The personal data is processed in order to (i) be able to process or fulfill the respective contract with you, in particular to process the payment or to assert our claims arising from or in connection with the respective contract, (ii) be able to conclude new contracts and/or (iii) be able to maintain existing contracts.


Furthermore, we may use your personal data for direct marketing purposes, i.e., to send you information about our products, services, company and promotions.


Furthermore, we process your personal data within the scope of the company's management (e.g. accounting, controlling).


c) Legal basis for data processing

The lawfulness of processing personal data is based on Article 6(1)(b) GDPR; this means that the processing of personal data is necessary for the performance of a contract, for taking steps prior to entering into a contract, and/or for maintaining the contract. Furthermore, we are also legally obligated to process your personal data (e.g., for reporting suspected money laundering).


​Furthermore, we have a legitimate interest in processing your data to conduct proper and efficient business operations, to implement various process and management optimizations, and to offer you our products and services. We also have a legitimate interest in processing your personal data for direct marketing purposes, in order to send you relevant offers and to inform you about new products and services as well as about our company.

Within the scope of our business relationship, you are only obligated to provide personal data that is necessary for establishing, executing, and terminating a business relationship, or that we are legally required to collect. Without this personal data, we will generally have to refuse to enter into a contract, or we may no longer be able to fulfill an existing contract, or we may have to terminate the contract.

We maintain a so-called "fan page" on various social media platforms. By clicking on the respective link, you will be redirected to our "fan page" on the corresponding social media platform.

We process all messages, likes, photos, content and other interactions that you submit, share, otherwise add or place on our social media pages, as well as your log files.

The purpose of this processing is to increase our online presence on various social media channels and to provide you with information about our company, products, and services. Insofar as the processing of personal data occurs within the context of communication between us and you, it serves to process customer feedback on our products and services and to improve our offerings. Furthermore, we would like to learn more about our customers' opinions and their interactions with our products and services in order to better address customer needs, provide optimal customer support, and offer you the opportunity to exchange information with other people regarding our company. In this context, we may process your personal data that you have published on social media in connection with us.

The lawfulness of data processing is based on our legitimate interest in data processing (Art. 6 para. 1 lit. f GDPR) in order to enhance our website presence, convey information to potential customers and achieve the aforementioned purpose, as well as for the implementation of pre-contractual measures (Art. 6 para. 1 lit. b GDPR). Furthermore, we process your personal data based on your consent.

5. PROCESSING OF SPECIAL CATEGORIES OF DATA

No special categories of personal data are processed.


6. COOKIES

6.1. General

When you use our website https://www.inpro-analytics.at/, we use cookies and similar technologies (e.g., pixel tags). A cookie is a small text file that is downloaded and stored on your device's hard drive via your browser. Cookies help us to ensure the correct functioning of our website, expand its functionality, optimize its features, and make our website more user-friendly. Cookies can also be used to collect statistical data and for marketing purposes.


Cookies, with the exception of essential and certain functional cookies (see also section 6.2), can be enabled and disabled via the consent manager on our website. Disabling cookies may limit the functionality of our website.

6.2. Types of Cookies

The least privacy-intrusive type of cookie is the essential cookie (also called necessary cookie). Essential cookies are technically necessary for the operation of, or for visiting, our website. We use these cookies without the user's consent in accordance with Section 165 Paragraph 3 of the Austrian Telecommunications Act 2021 (TKG 2021). Essential cookies cannot be deactivated.

6.3. Legal basis

Cookies, with the exception of essential cookies and necessary functional cookies (see also section 6.2), are set based on the user's consent. This consent can be withdrawn at any time without giving reasons. ​7. DATA TRANSFER TO A THIRD COUNTRY

Data transfers to a third country are permitted under the GDPR, provided that the third country in question has an adequate level of data protection (safe third country).

​8. DATA STORAGE

Unless you are notified of a different storage period, we process, in particular store, your personal data for as long as this is necessary to achieve the respective purpose (e.g. contract fulfillment, processing your request, etc.).


​However, we will not delete your personal data even if we are legally obligated to retain it, for example, under company or tax law regulations. Furthermore, we will continue to retain your personal data as long as you can assert claims against us. In this regard, we will retain the personal data necessary for defending against such claims. The statutory limitation periods under the Austrian Civil Code (ABGB) are generally between three and thirty years.


9. CONFIDENTIALITY

All our employees were bound to secrecy regarding information entrusted to them or learned by them in the course of their work, even after the termination of their employment.


10. DATA SECURITY

Data security is of utmost importance to us. We have implemented all necessary technical and organizational measures in accordance with Article 32 of the GDPR to ensure the security of data processing and to process personal data in such a way that it is protected against loss, destruction, access, alteration, or dissemination by unauthorized persons. Our IT infrastructure meets current security requirements and is regularly audited.


​Our website uses the industry standard SSL (Secure Sockets Layer) for encryption. This ensures the confidentiality of your personal data transmitted over the internet. You can recognize whether an encrypted connection is taking place by the closed padlock symbol in your browser's address bar.


Databases or records containing personal data can be compromised accidentally or through unauthorized access. As soon as we become aware of a data breach, we notify all affected individuals whose personal data may have been compromised. The notification includes a description of the measures being taken to address any damage resulting from the data breach. Notification is sent as soon as possible after the breach is discovered.

If your personal data is processed based on your consent, you have the right to withdraw this consent at any time with immediate effect. The lawfulness of the processing of your personal data up to the point of withdrawal remains unaffected.
